Fees Mediation

The Fees Mediation Committee is available either to mediate or arbitrate a complaint about the fees charged by a member of the Association to their client. For mediation or arbitration to occur, both the surveyor and the member of the public must be willing to participate. Applications for fees mediation must be received in writing by the Registrar:

As a mediator, the Committee will attempt, with the co-operation of both parties, to resolve any dispute with respect to fees. A mediated resolution is not binding.

Should both parties agree in writing to arbitration, the Fees Mediation Committee may arbitrate the dispute and in that case the decision of the Fees Mediation Committee is final and binding on all parties to the dispute.

A decision by the Fees Mediation Committee resulting from arbitration, certified by the Registrar, may be filed with the Superior Court of Justice, and when filed, the decision may be enforced in the same manner as a judgment of the court.
